1. General.
These terms and conditions of sale govern the use of the website https://www.artisanviolins.com, owned by J.P. Gheerardyn, violin maker and luthier with company number 0519.940.883 and established at Zandstraat 599, 8200 Bruges (St. Andries), Belgium, Europe. Anyone placing an order on the website (hereinafter referred to as the customer) confirms by placing an order that they are a natural person and have legal capacity. Persons without legal capacity must be represented by their legal representative, who is also bound by these terms and conditions of sale and must complete the order form themselves or grant the person without legal capacity explicit permission to do so. The provisions of Article 10 below regarding the processing of personal data remain fully applicable. Placing an order constitutes a payment obligation. Placing an order on the website constitutes explicit acceptance of these general terms and conditions of sale. Placing an order requires acceptance of the general terms and conditions. Anyone placing an order declares that they are familiar with and accept the seller's general terms and conditions. These general terms and conditions are always available and can be consulted on the website. The general terms and conditions that were posted on the website at the time apply to every order, excluding any older or newer provisions. Anything not expressly provided for in these terms and conditions of sale is governed by the provisions of Belgian law. The language of the concluded agreements is Dutch. 2. Offer and Order.
Orders can only be placed via https://www.artisanviolins.com/
The seller agrees to process orders placed on the website while supplies last. Online orders can only be processed if the customer has clearly identified themselves and paid via the website. The seller reserves the right to refuse orders in the event of serious suspicion of misuse of rights or bad faith, serious suspicion of commercial purposes unacceptable to the seller, or if the stock of a particular item is exhausted. An order is only final after acceptance of these general terms and conditions of sale, the prices, and the description of the offer. If anything in the offer or after placing an order is not clear enough, the customer can always contact www.artisanviolins.com for additional information via the contact form on the website or by email. All questions will be answered as quickly as possible.
3. Payment
The prices are those listed on the website at the time of ordering. Shipping costs are specified at the time of ordering before the order is finalized. Shipping costs are per country and will be communicated after ordering via email. Payment can then be made via PayPal or bank transfer. Payment must precede delivery. After payment for your purchase, you will receive an invoice from us via email in PDF format.
4. Order confirmation.
After payment, the seller will confirm the order by email.
5. Delivery.
The ordered item will be delivered to the address specified by the customer. The delivery location (domestic or international) affects the delivery time. The buyer will receive an email with a tracking number when the delivery is handed over to the carrier, allowing them to track the shipment via the carrier's e-tracker. We strive to ensure the shortest possible delivery time. The delivery time is a minimum of 1 business day and a maximum of 30 days after receipt of payment. The delivery time for products shipped to countries outside Belgium may be longer. The seller is not liable for any delays or failures to deliver due to the carrier. If, due to unforeseen circumstances, the item is not available within this period, we will notify you by email and inform you of the expected waiting time. You can then decide whether or not to wait for delivery. After these 30 days have passed and you do not wait for the deferred delivery, we will refund all payments (purchase price + shipping costs).
6. Returns.
In accordance with Articles VI 47-52 of the Code of Economic Law, consumers have 14 days to cancel the contract free of charge without giving any reason. Any item ordered through the webshop can be returned to J.P. Gheerardyn, violin maker - luthier, within fourteen calendar days of receipt. When returning, the item must be returned in its original packaging along with a copy of the invoice. Customers can return the item by mail within fourteen calendar days of receipt. The item should then be packed in the original shipping box and sent along with a copy of the invoice to the following address: J.P. Gheerardyn, violin maker, Zandstraat 599 - 8200 Bruges (St. Andries) - Belgium. In any case, returns will only be accepted if the item is undamaged, unused, and in its original packaging. Upon receipt, a credit note will be issued, and the buyer will be refunded in the same way as the payment was made. The buyer will then receive the purchase price excluding shipping costs. Return shipping costs are also the buyer's responsibility.
7. Warranty.
Any problem, defect, or damage related to the delivery of an item must be reported in writing within seven days by registered letter to the following address: J.P. Gheerardyn, violin maker, Zandstraat 599 - 8200 Bruges (St. Andries) - Belgium, or by email. We will then work together to find a solution. If the delivery needs to be returned to the seller, this will be done as stated in point 6.
The seller is not liable for force majeure, accidents, misuse, or improper handling of an item by the customer. An item with an accepted defect will be replaced or repaired free of charge. If the repair costs are disproportionate, the seller reserves the right to replace the item or exchange it for a similar item.
8. Signature and proof.
The customer accepts electronic proof. The customer is solely responsible for the accuracy of all information they provide. The customer confirms the order by paying for the item and shipping costs. The customer's final order confirmation constitutes acceptance of the order at the stated price. This customer confirmation constitutes signature and express acceptance of all transactions performed via the website.
9. Liability for use of the website.
The seller's website is intended to provide customers with general information about the seller's products and activities. The seller's obligation regarding access, the ordering process, delivery, or other services is solely best efforts. The seller reserves the right to suspend or discontinue the site, in whole or in part, at any time for maintenance, updating, or any other reason, even without prior notice. The seller cannot be held liable for any inconvenience or damage caused by internet use, any system failure, intrusion by outsiders, or a virus, nor for any information posted or processed on the site by third parties, or for any event that could be considered force majeure.
10. Privacy Protection.
The seller reserves the right to collect customer data for internal use only, either directly through the collection of data provided by the customer when placing an order, or indirectly through, for example, the use of cookies, newsletter registration, or orders. In accordance with the Privacy Act of 8 December 1992, the customer has the right to access, modify, and delete this data at any time if they no longer wish to receive information about the seller's activities. 11. Intellectual property.
The content of the seller's website is the exclusive property of the seller, and the operating system and its layout are the exclusive property of Combell and protected by copyright. Users who have their own website and wish to set up an automatic link between their own website and the home page or any other page of the seller's website, even for purely personal use, must explicitly request permission from the seller.
12. Jurisdiction and applicable law.
This agreement is subject to the provisions of Belgian law. In the event of a dispute, only the courts of the district of Bruges (Belgium) and, where applicable, the Court of Appeal in Ghent have jurisdiction.
